1. Processing Purposes

We process your data for the following purposes:

  • Managing your account;
  • Reviewing, processing and completing orders, returns and complaints;
  • Our own marketing goals and marketing purposes of parties we work with;
  • Managing our claims in the event that Blue Earth does not receive payment despite various warnings;
  • Comply with legal obligations / enforce rights and claims;
  • Making analyses, including for statistical purposes.

 

2. What data do we process?

Blue Earth processes the following data in its customer database:

Information about your person

We process your name, address, place of residence, gender, email address, telephone number, password and customer number.
This data will not be used for marketing purposes unless you have given us explicit permission to do so. Newsletters are sent by e-mail and only after registration. Every newsletter contains a link to unsubscribe. Your telephone number will not be used for commercial purposes and we do not provide address details to third parties for marketing purposes via print. Blue Earth may use the address details provided to it to send Blue Earth advertising material or Blue Earth trade names.

Order data

All data that is important to be able to process your order, including the data of orders, returns, cancellations, discounts, (deviating) delivery addresses, order channels and chosen payment methods.

Bookings and payments

We process deliveries, payments, corrections, interest entries, cost entries, payment arrangements, payment arrears and other entries on your account.

Correspondence and contact history

All correspondence (via post, email, telephone or social media) is processed and stored. This includes confirmations of orders or returns and payments, invoices, payment requests, account statements and handling complaints. In addition, it is stored whether you have given permission for other services such as our newsletter.

Use of our website

We keep track of which items have been placed in your shopping cart, which pages have been visited, the device with which you visit our site, your IP address, your cookie settings and the cookies themselves.

3. Security of your data

Blue Earth uses secure connections on all its web pages and passwords are always stored in a hashed form. When we transfer or receive your data on our website, we always use encryption technologies that are recognized as accepted standards within the IT sector.

We do not store more data than necessary and ensure that no particularly sensitive personal data is stored in our database, unless there is no other way. We take technical and organizational measures to prevent data loss or unlawful processing (such as attacks). We therefore guarantee an appropriate security level and have our site tested periodically.

All systems in which (sensitive) personal data are processed are equipped with antivirus software and the latest security-related patches of all other important software, as issued by the suppliers of this software.

Without providing information to these partners, the ordered items cannot be delivered and/or collected at your address or the alternative delivery address chosen by you. The logistics partners mentioned above may use third parties for the delivery of your package, ensuring that these third parties offer the same guarantees with regard to your privacy. In exceptional cases, an item can be delivered to you directly from the supplier without the intervention of the above-mentioned partners. When picking up a package at a PostNL Point, proof of identity is requested.

To provide you with the best possible service, good customer service is of great importance and our customer service needs access to your data.

Blue Earth uses the following third parties for its mail delivery:

Without providing information to these partners, we cannot send you letters, account statements or advertisements by post.

Follow-up of payment arrears

There can be various causes for payment arrears and Blue Earth tries to find a solution with the customer as much as possible. In the event of continuous non-payment, Blue Earth reserves the right to transfer or assign the file to a collection agency.

Other parties

On the basis of legal obligations, Blue Earth can provide data to the government, the police, the judiciary and other public-law bodies or other parties. In the event of (suspected) fraud, Blue Earth reserves the right to report it to the police, stating the necessary personal data or to have an external investigation carried out by a detective agency. In the context of legal proceedings, we may provide data to the parties involved, including lawyers, legal aid, bailiffs, engaged experts and the court.

In addition, Blue Earth may provide data to third parties for an analysis of its (internal) processes and/or customer portfolio to improve its services or to conduct a survey/customer satisfaction survey.

Please note: for all data processing by third parties, Blue Earth has concluded a processing agreement with the relevant third parties in accordance with the applicable (privacy) legislation.

 

5. Retention period

We store personal data for the duration of the active customer relationship and/or in case of another business relationship with Blue Earth (e.g. a newsletter permission). In case of deletion of your account and/or termination of the business relationship in any way, your personal data will be blocked and permanently deleted after expiry of the legal retention obligations resting on Blue Earth. If we keep personal data, it will only be used to comply with legal rules/requirements and/or to (be able to) enforce our own rights and claims and/or for statistical purposes. In any case, we do not store your data for longer than is necessary for the processing of the purposes for which it was collected.

Right of access

You have the right to request which personal data we have processed about you and to which third party(s) data has been provided.

Right to erasure and rectification

You have the right to adjust or have your personal data adjusted or removed. If there is incorrect information, it will be adjusted as soon as we receive your notification. If the legal requirements are met, personal data will be deleted if they are no longer necessary for the purpose for which the personal data was processed or if personal data has been unlawfully processed.

Personal data is excluded from erasure if it is used to fulfill our tasks (e.g. in the case of contractual obligations), for the exercise of our rights and claims and if we are obliged to retain data on the basis of a legal retention obligation .

Right to restriction

If the legal requirements are met, you can request that the processing of your personal data be restricted. This means that the (further) processing of certain data is discontinued.

Right to object

You have the right, at any time, to object to the processing of your personal data. We will then cease the processing unless we can demonstrate compelling legitimate grounds for the processing that outweigh your interests in accordance with legal requirements.
